Lutheran Services in America Urges Changes in New Requirements to Ensure Quality Access to Care for Older Adults
In response to the Centers for Medicare and Medicaid Services’ final rules for skilled nursing facilities and HCBS providers, Lutheran Services in America released a statement urging the administration to reconsider implementing these rules without further changes to address workforce shortages and adequate reimbursement rates.

Earlier this week, the Centers for Medicare and Medicaid Services (CMS) issued two long anticipated final rules. It is clear that these rules will make it harder to provide quality access to care for vulnerable older adults across the country. We will strenuously pursue all financial and programmatic remedies to alleviate the burden associated with these rules.

CMS Finalizes Key Rules: One-Size Fits All Skilled Nursing Minimum Staffing Mandate and Medicaid HCBS 80-20 Requirement
The Centers for Medicare and Medicaid Services issued two long anticipated final rules: the skilled nursing facility minimum staffing mandate and a new requirement for home- and community-based service providers that directs 80% of Medicaid payments be spent on wages for aides and nurses. We will continue to pursue all available remedies to further address these issues.
CMS Publishes SNF Minimum Staffing Standard Rule for Public Comment
Today, the Biden Administration officially published for public comment a proposed rule which would mandate minimum staffing levels at skilled nursing facilities. Lutheran Services in America will be submitting comments sharing our concerns about the proposed new requirement and helping you do the same.
